The bail bond process is a system that allows individuals who have been arrested to secure their release from jail while they await trial. Here’s how the process typically works:
Bail Hearing: After booking, a bail hearing is usually conducted where a judge determines whether the defendant is eligible for bail and sets the amount.
Bail Amount: If bail is granted, the judge will set a specific amount that must be paid for the defendant to be released.
Posting Bail: The defendant or someone on their behalf can pay the bail amount directly to the courts or they can opt for a bail bond. If paying directly, the bail amount is returned at the end of trial, provided the defendant appears in court as required.
Bail Bonds: If the bail amount is too high for the defendant or their family to pay outright, they can seek the services of a bail bond agent. The bail bond agent will charge a 10% non-refundable fee of the total bail amount, and may require collateral to secure the bond.
Release from Jail: Once the bail or bail bond is posted, the defendant is released from jail.
Court Appearances: The defendant is required to appear in court for all hearings related to their case. Failure to do so can result in the bail being forfeited, and the bail bond agent may seek to recover the full bail amount from the defendant or their co-signer.
Resolution of the Case: Once the case is resolved, whether through trial, plea deal, or dismissal, the bail is either returned. If a bail bond was used, the bond agent will keep the non-refundable fee.
